Magnificat Houses, Inc. (MHI) Waiver
Section 1: Volunteer Release and Waiver of Liability Adult Form
This Release and waiver of Liability executed by the volunteer, in favor of Magnificat Houses Inc, a Texas non-profit corporation, its directors, officers, employees, and agents (collectively, "MHI").
I desire to work as a Magnificat Houses volunteer and engage in the activities related to being a volunteer. I understand that the activities may include constructing and rehabilitating residential buildings, working in the MHI offices, and living in housing provided for MHI volunteers.
I do hereby freely, voluntarily, and without duress execute this Release under the following terms:
Waiver and Release: I do hereby release and forever discharge and hold harmless MHI and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my work with MHI.
I understand and acknowledge that this Release discharges MHI from any liability or claim that I may have against it with respect to any bodily injury, personal injury, illness, death or property damage that may result from my work with MHI, whether caused by the negligence of MHI or its officers, directors, employees, or agents or otherwise. I also understand that, except as otherwise agreed to by MHI in writing, MHI does not assume any responsibility for or obligations to provide financial or other assistance, including but not limited to medical, health, or disability insurance, in the event of injury or illness.
Medical Treatment: Except as otherwise agreed to by MHI in writing, I do hereby release and forever discharge MHI from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with my work with MHI.
Assumption of Risk: I understand that the work with MHI may include activities that could be hazardous to me, including, but not limited to, construction, loading and unloading, transportation to and from the work sites. In connection thereto, I recognize and understand that activities at MHI may, in some situations, involve inherently dangerous activities.
I hereby expressly and specifically assume the risk of injury or harm in these activities and release MHI from all liability for injury, illness, death, or property damage resulting from the activities of my work with MHI.
Insurance: MHI carries secondary insurance for our volunteers. It is an Excess Accidental Medical Program designed to provide coverage in the event of an accidental bodily injury or death. Volunteers are covered while they are participating in a MHI sponsored activity. This coverage will wrap around the volunteer's personal health insurance. If the volunteer does not have any health insurance, then this policy becomes primary.
Photographic Release: I do hereby grant and convey unto MHI all right, title, and interest in any and all photographic images and video/audio recordings made by MHI during my work there, including, but not limited to, royalties, proceeds, or other benefits from such photographs or recordings.
Other: I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and that this Release shall be governed by and interpreted in accordance with Texas State laws. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of the Release, which shall continue to be enforceable.
Section 2: Confidentiality/Hipaa Statement
Magnificat Houses complies with HIPAA regulations, which state that all patients, employees and volunteers have the right to have the confidentiality of their Protected Health Information, which can include medical, financial, records, data, personal and other information, etc., protected from unauthorized viewing, use and disclosure. We further believe that all employees of the organization must have the same right of confidentiality regarding their personal data, records, and information, and that the organizations information must be safeguarded as well.
In order to safeguard these rights, employees, volunteers, and students may only look at, use or disclose patient, employee or organization information only for reasons necessary to the performance of their duties. Any unauthorized viewing, use or disclosure of such information will provide grounds for termination of employment or volunteer/student affiliation. When in doubt as to whether or not information is considered to be Protected Health Information and/or considered confidential, you understand that is your responsibility to discuss the matter with your supervisor before a violation occurs.
I acknowledge being informed of this Statement concerning confidential information and its treatment and agree to adhere to and uphold the expectations of this Statement.
Section 3: Volunteer Code of Conduct
Organization OverviewMagnificat Houses, Inc. (MHI) is a 501(c)(3) nonprofit creating safe, welcoming environments for all individuals regardless of race, gender, sexual orientation, or ability.
Volunteer StandardsVolunteers perform tasks without compensation, must be officially enrolled before beginning service, and are expected to perform duties to the best of their abilities, arrive at assigned times, and remain loyal to the organization's mission.
Before You Begin
- Minors (under 18) must provide written parental consent
- Assessment, orientation, and training provided; background checks may be required
- Required forms: Confidentiality/HIPAA agreement and Release and Waiver of Liability
Attendance: Notify supervisor in advance if unable to attend.
Confidentiality: All privileged information must remain confidential.
Conflict of Interest: Disclose any potential conflicts to the MHI Director and complete a Disclosure Form.
Dress Code: Business casual. No open-toed shoes, slippers, spaghetti straps, or miniskirts/dresses. Pants at waist.
Donated Items: Volunteers may not eat or take donated items, which are prioritized for clients.
Phone Use: Cell phones allowed; photos encouraged.
Zero Tolerance: MHI has zero tolerance for sexual or general harassment, violence, threats, intimidation, and drug/alcohol use or possession on premises.
Political Activities: Must be conducted on personal time without use of MHI's name, materials, or property unless approved by leadership.
Rights & Dismissal: MHI provides equal opportunity regardless of race, color, religion, sex, age, national origin, veteran status, disability, or protected status. Volunteers may be dismissed for gross misconduct, theft, abuse, policy violations, or failure to perform duties satisfactorily.
